Terms and Conditions

These terms and conditions (hereinafter "T&C") govern access to and use of the K-PAY platform, an infrastructure enabling the collection and disbursement of payments. By creating an account, you unreservedly accept these T&C in their entirety.

Registration is free and provides unlimited access to a test environment (sandbox). Access to the production environment is subject to identity verification (KYC) of the user. K-PAY reserves the right to refuse account creation or to restrict access to the service without having to justify the reason.

• Provide accurate information and keep your details up to date.
• Keep your API keys and login credentials confidential.
• Use the service only for lawful activities, in compliance with applicable regulations.
• Not use the platform for fraud, money laundering, or financing illegal activities.
• Not attempt to circumvent security measures, verification systems, or platform limits.

K-PAY implements monitoring mechanisms designed to protect the platform and its users. In case of activity deemed suspicious, K-PAY reserves the right, at its sole discretion and without prior notice, to:

• Temporarily or permanently suspend the user's account.
• Block any ongoing or future transactions.
• Freeze funds held in the account pending investigation.
• Request additional supporting documents to verify the identity or legitimacy of operations.
• Report the activity to the relevant authorities in compliance with legal obligations regarding anti-money laundering and counter-terrorism financing.
• Permanently terminate the account if investigations confirm fraudulent or illicit use.

Use of the service is subject to a commission fee per transaction, on both deposits and withdrawals. Details of the applicable rates are available on the Pricing page.

Specific terms may be negotiated for high-volume usage.

K-PAY strives to ensure continuity of service. Maintenance operations may, however, result in temporary interruptions, which will be communicated in advance wherever possible.

The user remains solely responsible for their use of the service and for the payments they initiate or receive. K-PAY acts as a technical intermediary and cannot be held liable for commercial disputes between a merchant and their own customers.

K-PAY is committed to protecting the personal data of its users in accordance with applicable legislation. Data collected is processed strictly for the following purposes:

• Providing and securing the service.
• Processing payment operations.
• Complying with legal and regulatory obligations (anti-money laundering, identity verification).
• Fraud prevention and platform security.
• Communicating with the user and providing technical support.

In the event of a breach of these T&C, suspicious or fraudulent activity, K-PAY reserves the right to suspend or close an account, without prejudice to any applicable legal data retention obligations. The user will be informed of the reasons for suspension or termination as soon as possible, unless disclosure of such reasons may compromise an ongoing investigation.

These T&C may be updated. Users will be informed of significant changes; continued use of the service constitutes acceptance of the version in force.

These T&C are governed by the law in force in the Republic of Cameroon. Any dispute shall be submitted to the competent courts.

Cross-border operations (sending or receiving funds from or to a foreign country) are subject to specific conditions depending on the account type:

• Freelance and Student accounts: international transactions are not currently available. An update is underway to extend these services to these account types.
• Business accounts: international transactions are available upon submission of an official document authorising cross-border financial operations (approval, import-export licence, or any equivalent authorisation). This document must be sent to support by email after account verification.

In the absence of this document, each user must operate exclusively within their country of residence. It is strongly advised against creating wallets in other countries without having reliable contacts or guaranteed recovery on site.

K-PAY reserves the right to suspend any cross-border operation that does not comply with applicable regulatory requirements.
